Terms of Service

Welcome to LinksLoop. These Terms of Service ("Terms") govern your use of the LinksLoop mobile application ("App") operated by Wide Eyes Little Hands LLC (d/b/a LinksLoop, "we," "us," or "our"), based in Milwaukee, Wisconsin. By creating an account or using the App, you agree to these Terms. Please read them carefully.

1. Acceptance of Terms

By downloading, installing, or using LinksLoop, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

We may update these Terms from time to time. We will notify you of material changes through the App or by email. Your continued use of LinksLoop after changes are posted constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 13 years old to use LinksLoop. By using the App, you represent that you meet this age requirement. Users between 13 and 17 should have a parent or guardian review and agree to these Terms on their behalf.

LinksLoop is designed for adult golfers and certain features (such as gambling game preferences) are intended for users who are of legal age in their jurisdiction.

3. Your Account

• You may create an account using Google Sign-In or Apple Sign-In.
• You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
• You agree to provide accurate, current, and complete information in your profile.
• You may not create more than one account per person.
• You may not use another person's account without their permission.
• If you believe your account has been compromised, contact us immediately at linksloopapp@gmail.com.

4. User-Generated Content

4.1 Your Content

You may post content to LinksLoop, including text, photos, videos, stories, scores, and messages ("User Content"). You retain ownership of your User Content. However, by posting it on LinksLoop, you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, display, reproduce, distribute, and modify your User Content in connection with operating and improving the App.

This license exists only for the purpose of operating LinksLoop. If you delete your content or your account, we will remove your content from the App within a reasonable time, though cached or archived copies may persist temporarily, and content shared with other users (such as in round histories or chat messages) may remain visible in their experience.

4.2 Content Responsibilities

You are solely responsible for the content you post. You agree not to post content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Infringes on the intellectual property, privacy, or other rights of any third party.
• Contains spam, advertising, or commercial solicitations without our prior permission.
• Contains malware, viruses, or other harmful code.
• Impersonates another person or entity.
• Encourages illegal activity.
• Targets, bullies, or harasses other users.

4.3 Content Moderation

We reserve the right, but are not obligated, to review, remove, or disable access to any User Content at our sole discretion, for any reason, including content that we believe violates these Terms or is otherwise harmful. We are not responsible for any User Content posted by users of the App.

5. Acceptable Use

You agree to use LinksLoop only for its intended purpose as a social golf platform. You agree not to:

• Use the App for any illegal purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to the App, other user accounts, or our systems.
• Reverse engineer, decompile, or disassemble the App.
• Use automated systems (bots, scrapers, etc.) to access the App.
• Interfere with or disrupt the App or its servers and networks.
• Collect personal information about other users without their consent.
• Use the App to send unsolicited messages or spam.
• Create fake accounts or misrepresent your identity.
• Use the App to promote gambling where it is illegal in your jurisdiction. LinksLoop provides tools for tracking friendly golf wagers; it is not a gambling platform, and users are responsible for complying with local laws.

6. Social Features and Interactions

6.1 Friends and Connections

You can send and receive friend requests, create golf events, and interact with other users. You are responsible for your interactions with other users. We are not a party to any disputes between users.

6.2 Live Rounds

When you go live during a round, your scores, leaderboard position, and live updates (photos, videos, text) may be visible to other participants and connections. Participation in live rounds is voluntary.

6.3 Reporting and Blocking

If another user behaves inappropriately, you can block them or report them through the App. We will review reports and take action as we deem appropriate, which may include warnings, content removal, or account suspension or termination. Filing false or abusive reports is a violation of these Terms.

6.4 Messaging

Chat messages in live rounds and group messages are private to the participants of those conversations. We do not monitor private messages in real time, but we may review reported messages to enforce these Terms.

6.5 Side Games (Nassau, Skins, and Other Trackers)

LinksLoop offers optional side game tracking features (such as Nassau and Skins trackers) for entertainment purposes only. These features are scorekeeping tools and do not constitute a gambling service. Specifically:

• LinksLoop does not facilitate, process, hold, or manage any real-money wagering or financial transactions related to side games.
• LinksLoop does not take a commission, fee, or rake from any wagers between users.
• Any monetary stakes displayed within side game trackers are informational labels only and do not represent actual financial transactions processed by LinksLoop.
• Users are solely responsible for any personal arrangements made with other players. LinksLoop is not a party to any such arrangements.
• Users must comply with all applicable local, state, and federal laws regarding friendly wagering in their jurisdiction.
• LinksLoop assumes no liability for any losses, disputes, or legal consequences arising from side games or personal wagers between users.

7. Intellectual Property

The LinksLoop name, logo, app design, and all original content, features, and functionality are owned by Wide Eyes Little Hands LLC and are protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks or branding without our prior written consent.

If you believe that content on LinksLoop infringes your copyright, please contact us at linksloopapp@gmail.com with the following information:

• A description of the copyrighted work you claim has been infringed.
• The location of the infringing content within the App.
• Your contact information.
• A statement that you have a good faith belief that the use is not authorized.
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

8. Third-Party Services

LinksLoop uses third-party services, including Google Firebase, Google Sign-In, Apple Sign-In, and Apple WeatherKit. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party service providers.

The App may also contain links to third-party websites or services (such as golf course websites). We do not control and are not responsible for their content or practices.

9. Disclaimers

LinksLoop is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The App will be available at all times or free from errors or interruptions.
• Weather data, course information, or other third-party data will be accurate or up to date.
• Scores, leaderboards, or round data will be error-free.
• The App will meet your specific requirements.

Golf involves inherent risks. LinksLoop is a social and organizational tool and is not responsible for any injuries, accidents, or incidents that occur on or off the golf course.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Wide Eyes Little Hands LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising out of or in connection with your use of the App.

Our total aggregate liability for any claims arising from or related to the App shall not exceed the amount you paid to us (if any) in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Wide Eyes Little Hands LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to:

• Your use of the App.
• Your User Content.
• Your violation of these Terms.
• Your violation of any rights of another person or entity.

12. Account Suspension and Termination

We may suspend or terminate your account at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms. Upon termination:

• Your right to use the App will immediately cease.
• We may delete your account data in accordance with our Privacy Policy.
• Provisions of these Terms that by their nature should survive termination (such as intellectual property, limitation of liability, and indemnification) will remain in effect.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the App shall be resolved in the state or federal courts located in Milwaukee County, Wisconsin, and you consent to the personal jurisdiction of those courts.

Before filing any formal legal action, you agree to attempt to resolve disputes informally by contacting us at linksloopapp@gmail.com. We will make good-faith efforts to resolve the matter within 30 days.

14. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding LinksLoop.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any provision of these Terms is not a waiver of that provision or our right to enforce it later.
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
• No Agency: Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and us.
